Legal Videographer Clifford "Kip" O’Brien holds the Certified Deposition Video Specialist (CDVS) certification through the American Guild of Court Videographers (AGCV). We strictly adhere to Court procedural rules and to the standards established by the AGCV.

VIDEO EQUIPMENT:
Our firm uses professional broadcast quality high-definition video cameras. A redundant recording system is used to capture the audio and video in the event of an equipment failure and securely archived following the deposition.

AUDIO EQUIPMENT:
Our firm uses professional broadcast quality Lavalier microphones to capture testimony. Each attorney and the witness are provided with a Lavalier microphone to record their voices. An audio mixer is used to monitor and adjust the audio levels to ensure each person’s voice is accurately captured. A neutral color backdrop is used behind the witness to create a background that is not distracting when the video recording is presented to jurors.

MEDIA:
We can provide you with a copy of the video recording in any format required on a USB flash drive, secure online storage, DVD, MPEG-1, DepoView ©DVD, which allows you to search and save pertinent segments of testimony for you to use at trial. Video-Text Synchronization is compatible with Sanction, Trial Director, Summation, Visionary, LiveNote and Power Point trial presentation software.

Why consider a Video Deposition?

Videotaped testimony is a persuasive communication tool. Preserving testimony by video recording is efficient and cost effective, perhaps scheduling difficulties exist with a witness who might not be available for a trial. Often medical professionals are not available to be on stand-by for a trial; therefore, their testimony can be video recorded and preserved to present later at trial.

The way someone answers a question can be just as important as the answer itself. Is the witness hostile? Is the witness sincere?

Video testimony has been proven to be more compelling than just listening to testimony being read aloud or being played from an audio recorder. Instead of reading a transcript to a jury, a video will show the witness’s appearance, every inflection in speech, body language, emotion and hesitancy of the witness not conveyed by a written transcript. Therefore, video depositions can be crucial to winning a case, because without it, there would be no facial expressions or body language to observe.

Research has demonstrated that jurors retain testimony up to 6 times better when seeing witnesses along with hearing them speak.

Attempting to settle a case?

Day-in-the-Life Video to convince the opposition they cannot win the case in a court of law by introducing a Day-in-the-Life Video. This is a 10 to 15-minute video chronicling the day to day life of an injured plaintiff to show opposition or jurors. Primarily, this video documents the plaintiffs' daily activities to capture the quality of life and how it has been altered by injury, illness and/or pain. The video can vividly demonstrate the plaintiffs' limitations, frustrations, and dependencies during activities such as rising from bed, eating, bathing, transportation, work, and therapy. The Day-in-the-Life Video will bring jurors up close and personal into the plaintiff's daily living environment in a way virtually impossible to communicate through a written transcript.

Site Inspection Video of construction disputes or insurance inspections are an important part of many cases and documenting the scene or equipment accurately can be a vital tool to preserve evidence and verify the facts.

Accident Site Video of the accident site could include video of where the accident occurred and any evidence or equipment that was involved in the accident. Video is an exceptional way to preserve evidence and verify facts to present to jurors, experts or insurance adjusters what transpired in an accident.
